Article 1. General
These Terms and Conditions apply to all offers and agreements, as well as to all products and services provided by Candyville, unless expressly agreed otherwise in writing.
The applicability of any general or specific conditions of the Buyer is expressly rejected by Candyville.
All prices are stated in euros (€), exclusive of sales tax (VAT) and other government levies, unless otherwise stated.
Candyville is not liable - either by law or contract - for consequential damages suffered by Customer or third parties in connection with the use of the products. This includes, but is not limited to, loss of profits, loss of business, loss of data and intangible damage.
Deviations from and additions to provisions in the agreement and/or these terms and conditions are valid only if set forth in writing by Candyville and apply only to the agreement in question.
Article 2. Quotations
Candyville is only bound by an offer if the Buyer confirms its unchanged acceptance in writing within 8 days, unless otherwise stated on the offer.
Article 3. Agreement
The Customer is bound by the agreement in all cases, even if it has been agreed upon orally or by e-mail.
Candyville reserves the right not to accept orders or assignments without giving reasons, or only under different conditions. In the latter case, the Customer has the right to cancel the order free of charge.
Candyville has the right, if necessary for proper execution, to have work done by third parties.
Article 4. Delivery time
All delivery times mentioned by Candyville are approximate based on the data known at the time of the agreement. These times are not binding.
Exceeding the delivery time shall not entitle the Customer to compensation or dissolution, unless otherwise agreed in writing.
Upon cancellation of the order by Candyville, it has the right to take back the unpaid part of the delivery, without loss of the right to compensation.
If the maximum delivery time of 30 working days is exceeded, the Customer has the right to dissolve the agreement free of charge. This must be done in writing (by e-mail, fax or letter). Any payments will be refunded within 30 working days.
Article 5. Modification of the agreement
If, during execution, it becomes apparent that adjustment is necessary, the parties will determine this by mutual agreement.
Changes may affect the delivery time. Candyville will notify the Customer in a timely manner.
If the change has financial or qualitative consequences, Candyville will notify in advance. In the case of a fixed fee, the extent to which the change affects this fee will be indicated.
If the change is due to circumstances attributable to Candyville, no additional costs will be charged.
Article 6. Termination and dissolution
Upon early termination, Candyville is entitled to reimbursement of expenses incurred and a reasonable portion of the total compensation depending on the work already performed.
Claims of Candyville against the Customer are immediately due and payable in the following cases:
if after the conclusion of the agreement circumstances become known that suggest that the Customer is not fulfilling its obligations;
if the Customer does not provide the requested security for performance.
In these cases, Candyville may terminate the contract without prejudice to its right to compensation.
Candyville reserves the right to cancel orders in whole or in part without giving any reason.
Article 7. Returns
You have up to 14 days after receipt to return all or part of your order.
A return must always be notified in advance in writing by e-mail at info@candyville.eu. Please include your order number and the items you wish to return.
Return costs are always at your own expense and will not be reimbursed by Candyville.
Always keep the track & trace code of your return shipment. We cannot accept returns without proof of shipment.
Products serve:
To be unopened (opened products will not be refunded).
To be stored in proper conditions: between 10°C and 22°C, dry, and free from direct sunlight.
Exceptions
No returns are possible when the correct item number is delivered as ordered.
Reimbursement upon return
If you return part of your order, you will only receive a refund for the purchase price of the returned products.
When you return the entire order, you will receive a refund of the purchase price as well as the shipping costs of the return shipment.(Note: return shipping costs themselves are never refunded).
Article 8. Products not delivered or damaged
Upon receipt, always check the delivery immediately. Any discrepancies or missing products must be reported within 48 hours.
If a product is damaged to the point that it cannot be consumed, please contact Candyville (via email, phone, chat or Facebook) as soon as possible - but no later than 48 hours.
When complaining about a damaged product, you should always keep the product. Candyville may ask for photos or return of the product.
